Eminent Domain: What do you think?

I hope you all enjoyed the lesson on eminent domain. I think you all learned quite a bit, and hopefully you've already gone home and shared with your families what you've learned about this important issue. I hope that understand that anyone can be affected by this government "tool." Now I want you to sound off – I want to know what you think. Here's a little something to get you started:

"This is America. This is a country with free enterprise. You have all the rights to own your property, your own home, your own business. You have the right to build your American dream."

"The use of eminent domain is a delicate tool, but it is a tool and it helps keep a community clean; it helps keep a community vibrant. It's a good tool and, definitely, I don't think it should be taken away."

These are quotes by two of the people interviewed in the film Unintended Consequences: Eminent Domain. Use them to get your thoughts rolling. Does eminent domain have a role to play in our communities? What should government do to protect private property rights? What can we do as citizens to ensure that these rights are protected? I don't expect you to answer the questions directly (but you may as part of your thought process). These questions are intended to help you think about the issue.

This will be an open forum, which means your comments should post immediately. Do not copy the thoughts of those that post before you, but you can certainly work off of them. That means that you can comment on a comment – you can disagree, agree, or just comment on the thoughts of someone else – but give me your ideas.

I think that eminent domain is a useful tool because it helps our community for our needs but should not be made so that it would overrun a smaller business or property to fit what was good for the government taxwise. So I still think this is a good tool but has the potential to be very emotional for the people that are affected by it.

I think eminet domian is a good tool but to a certain extend. i dont think that you should be forced from your home without the government giving you exactly what its worth. If someone doesnt want to move I dont think they should be forced, I think they should negotioate and find some sort of comprimise.

Eminent domain plays an important role in our society today as it relates to the government, the citizens, and the economy. According to amendment 5 of the Bill of Rights, the government controls eminent domain by only allowing
it for public use with just compensation. However, over the years, the gov. has used eminent domain by selling private land to developers to make nice establishments. This has caused higher taxes for the government, which makes it a useful tool for government. Eminent domain in the lives of citizens is a little different because they are the ones who have to give up their land if necessary. In some cases, they think from one of the interviewee's perspective from the video. Their mindset is that this is America and everyone is entitled to their own property. Because of this, I believe that eminent domain isn't a good tool for citizens. We can solve this problem by the government not use eminent domain for developments and just for strict public uses. Finally, eminent domain is like a one-way street when it comes to the economy. It's a useful tool for the economy because it's bringing taxes so there's more money.

I think eminent domain is a very resourceful tool if it is used they way that the Constitution stated it should be used. Which is to be used only to better improve the community and public society. As long as eminent domain isn't used to cheat and shut-down smaller businesses for the bigger companies and private owners.

I think it is a good tool.

I think eminent domain is a great tool to be included in our country. However, the government is taking it much too far. It should only be used for public roads that are REALLY needed, hospitals when there is not any near, and schools if there is an overflow of students. Once people take it as far as expanding a parking lot, or building a better neighborhood or restaurant that should not be tolerated. Only real logical and reasonable reasons should be recognized. Also, house and business owners should get a more reasonable price then what its exactly worth or less because they should get a little extra money for 1) they were forced out of there homes/businesses, and 2) they need some money to get back on their feet.

The government should protect our private rights by bareley using eminent domain or not do houses with families. Also, they should do it in a different location intead of the busy plaes. Citizens can help by supporting other people whos houses are going to be destroyed.

hey I think eminent doamian is a good thing but not always. some times people need their house and/or what they have and sometimes its not fair if they have to have that taken away even for just compensation. some people want to get super highways but not when it cuts through their house.

Emminent Domain is good in some ways but it is usually just bad. A way that it is bad is that the government should not be able to take the houses for tax revenue.

I like element domain is good for the cummonity financy for our economy and for schools, hospitals and other public uses in many ways but it does at some times it is bad like in the video when the womans neighborhood was being taken for no good reason it could worsen our economy.

I belive that eminate domain is a good thing if and when used properly. If part of my property is used to expand a road or something im fine with that but if its used for some random millionare to build his manson im no going to be too happy.

I think that eminent domain is a useful and good tool but up to a certain point. For example, like what Eden said if people dont want to move they shouldn't be forced to.

I can't decide if Eminent Domain is a good tool or a bad tool. First, people get there houses taken away, which affects them greatly because that was usually the place that they raised their kids. Even though you get money for the property, I still don't like the idea of Eminent Domain. But in some ways it is good, like building a school, which is there to teach kids, not raise tax, like a large business or a parking lot. So to me I believe that the tool, Eminent Domain, is good when used in certain situations.

I believe eminet domian is a good tool, but it can be used in different ways. It can hurt people, by taking their homes to just make the city look better, and give the house to a different person. This is like they are just wanting more money or a better image of themselves. Eminet domain can be to a good use by raising money, and helping build things that are accually needed in the public community.

I think eminent domain can be both a good and a bad tool, because even though the government is taking away private property for public use, the owners' home is still being taken away from them whether they like it or not. I also agree with Eden, I don't think people should be forced to move and instead should try to find some kind of compomise.

Caston also makes a very good point, eminent domain should only be used for things that are really needed, not just convenient.
